Terms of Service

1. Acceptance of Terms

By accessing or using DriveAruba ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. DriveAruba is a peer-to-peer marketplace that connects vehicle owners ("Hosts") with individuals seeking to rent vehicles ("Renters").

2. Eligibility

You must be at least 21 years old to rent a vehicle and at least 18 years old to list a vehicle. All users must have a valid driver's license and complete identity verification before using the Platform.

3. Account Registration

You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Host Terms

Hosts are independent vehicle owners who list their vehicles on the Platform. By listing a vehicle, you represent and warrant that:

• You own the vehicle or have legal authority to rent it
• The vehicle is properly insured, registered, and roadworthy
• All listing information (photos, description, pricing) is accurate
• You will maintain the vehicle in safe operating condition

DriveAruba charges a 25% service fee on each completed booking. Hosts receive 75% of the booking total.

5. Renter Terms

Renters agree to:

• Return the vehicle in the same condition as received (normal wear excepted)
• Use the vehicle only for lawful purposes on public roads in Aruba
• Not sublet, sell, or transfer the vehicle to any third party
• Pay for any traffic violations, tolls, or fines incurred during the rental period
• Report any accidents or damage immediately

Renters may cancel free of charge up to 24 hours before the trip start time. Cancellations within 24 hours may incur a partial fee.

6. Insurance & Liability

Every trip on DriveAruba includes up to $1,000,000 in third-party liability coverage. Additional physical damage protection is provided. Full insurance terms are available on our Insurance page. DriveAruba is not a party to the rental agreement between Host and Renter.

7. Payments & Fees

All payments are processed securely through the Platform. The total price displayed during booking includes all applicable fees. Host payouts are processed within 2 business days of trip completion.

8. Prohibited Conduct

Users may not use the Platform for any unlawful purpose, attempt to circumvent Platform fees, provide false information, harass other users, or otherwise violate these terms.

9. Limitation of Liability

To the fullest extent permitted by law, DriveAruba shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
